The collective bargaining law in New York State for public employees designates the successful labor organization as the exclusive representative for all employees within the bargaining unit.

Exclusive representation requires the union to expend resources for the collective bargaining, contract administration and disciplinary protection of all employees regardless of union membership.

For the past twenty years, the New York legislature has temporarily extended, for two years at a time, the requirement that all represented public employees pay an agency fee to cover all required services.

This provision expires on October 1, 1997, and has not been renewed as of this time.

RESOLVED: That the AFL-CIO is on record supporting the passage of a permanent agency shop law for public employees in New York State.

RESOLVED: That the AFL-CIO will assist the New York State AFL-CIO to obtain passage of this important legislation.

RESOLVED: That a copy of this resolution be sent to the Governor of New York State, all members of the New York State Senate and Assembly, the labor press and media in general.
