The AFL-CIO is deeply concerned at the apparent refusal of the “Miguel López Trujillo” Union of the Confederation of Workers of Mexico (CTM) to schedule a new legitimation vote on the collective bargaining agreement at the General Motors plant in Silao, Guanajuato, Mexico.
Under the labor law reform enacted in 2019, and in conformity with the USMCA, the CTM requested and the Mexican Secretariat of Labor and Social Welfare (STPS) supervised a contract legitimation vote on April 20-21, 2021. The STPS suspended the voting process after obtaining evidence of ballot tampering, and filed a criminal complaint with the Attorney General of Guanajuato. On May 11, in response to a complaint filed by workers at the GM plant in Silao, the STPS emitted a resolution that ordered the union to hold a new vote within 30 calendar days of notification.
The following day, the Office of the United States Trade Representative (USTR) requested that Mexico conduct a review of the contract legitimation process to determine whether a Denial of Rights under the USMCA occurred at the Silao plant, to which Mexico responded positively.
According to the protocol for legitimation published by the STPS, 10 business days before the new vote the CTM was required to publish the notice informing workers at GM Silao so that they would be able to participate in the vote and know the list of all those workers with the right to vote; however, that deadline has passed and neither the union nor STPS has indicated that this notification has occurred. On June 11, the deadline set by the STPS to hold a new vote also expired.
If this is the case and non-compliance with the resolution of the STPS is allowed to stand, a union publicly accused of vote tampering by the labor authority can act with impunity and retain control of the collective bargaining agreement indefinitely, without consequence or sanction, and despite the fact that a majority of the workers who were able to cast their ballots did so voting against the “Miguel López Trujillo” CTM contract. Such inaction would clearly exacerbate the Denial of Rights that is already the subject of the USTR-initiated complaint.
The AFL-CIO calls on Mexico to act immediately to protect the rights of the GM workers by (1) convening a free and fair vote at the Silao plant under the supervision of STPS inspectors to prevent intimidation and fraud, and (2) conducting a comprehensive investigation of the actions of the CTM and the company over the past two years including the complaints filed for firing and harassment of union dissidents. We call on USTR to use the USMCA enforcement mechanism in a decisive manner to send a clear message that fraud, intimidation, and retaliation against workers who demand their democratic rights will not be tolerated.
Declaración de la AFL-CIO sobre la Negativa de la Confederación De Trabajadores De México (CTM) de Cumplir la Orden de la Secretaría de Trabajo Mexicana de Realizar la Votación de La Legitimación del Contrato Colectivo de Trabajo en la Planta de General Motors En Silao, México.
La AFL-CIO está profundamente preocupada por la aparente negativa del Sindicato “Miguel López Trujillo” de la Confederación de Trabajadores de México (CTM) de programar la votación de legitimación del convenio colectivo en la planta de General Motors en Silao, Guanajuato, México.
Bajo la reforma a la legislación laboral promulgada en 2019 y de conformidad con el T-MEC, la CTM solicitó a la Secretaría de Trabajo y Previsión Social de México (STPS) supervisara la votación de legitimación del contrato los días 20 al 21 de abril de 2021. La STPS suspendió el proceso de votación al encontrar evidencias de manipulación de boletas, por lo que presentó una denuncia penal ante la Procuraduría General de Justicia de Guanajuato. El 11 de mayo, en respuesta al recurso de inconformidad promovido por trabajadores de la planta GM, Silao, la STPS emitió resolución en la que ordenó al sindicato que realizara una nueva votación dentro de los 30 días calendario posteriores a la notificación.
Al día siguiente, la Oficina del Representante Comercial de Estados Unidos (USTR) solicitó a México que realizara una revisión del proceso de legiticimación para determinar si se produjo una Denegación de Derechos en virtud del USMCA en la planta de Silao, a lo que México respondió positivamente.
Acorde con el protocolo de legitimación emitido por la STPS, la CTM debía publicar la convocatoria 10 días hábiles antes de la votación en la planta de GM Silao para que los y las trabajadoras pudieran emitir su voto y conocer la lista de quienes tienen derecho a ejercerlo; sin embargo, la fecha límite para cumplir la resolución de la STPS ya pasó y ni el sindicato ni la autoridad laboral han indicado que se publicara la convocatoria en el centro de trabajo. El 11 de junio pasado también se venció la fecha limite puesta por la STPS para realizar la nueva votación.
Si este es el caso y se permite el incumplimiento de la resolución de la STPS, un sindicato acusado públicamente de alteración del voto por la autoridad laboral puede actuar impunemente y retener el control del convenio colectivo de manera indefinida, sin consecuencias o sanción; y a pesar del hecho de que la mayoría de los trabajadores que pudieron votar lo hicieron contra contrato de la CTM “Miguel López Trujillo”. Esta inacción claramente exacerbaría la Denegación de Derechos que ya es el tema de la queja iniciada por el USTR.
La AFL-CIO pide a México que actúe de inmediato para proteger los derechos de los trabajadores de GM y: (1) convoque a una votación libre y justa en la planta de Silao bajo la supervisión de los inspectores de la STPS para prevenir la intimidación y el fraude, y (2) realice una investigación exhaustiva de las acciones de la CTM y la empresa durante los últimos dos años, incluidas las denuncias por despido y hostigamiento de disidentes sindicales. Hacemos un llamado al USTR para que utilice de forma determinante el mecanismo de aplicación del T-MEC para enviar un mensaje claro de que no se tolerará el fraude, la intimidación y las represalias contra los trabajadores que exigen sus derechos democráticos.
