Letter Urging the Salvadoran Government to Respect the Democratic Processes of Unions

Dear Minister Castro:

I am writing to follow up on the letter I sent on behalf of the twelve and half million members of the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO) on November 5, 2019. That letter expressed our concern over the Salvadoran government’s actions to undermine the democratic union structures and authentic worker voice and representation at Union of Workers of the Salvadoran Social Security Institute (STISSS). Today, we urge you to respect the workers’ decision and not interfere in their internal democratic process in the lead up to the December 13, 2019 convention, in which union members will elect their executive board.

In December 2018, STISSS duly elected its executive board during its congress. In April 2019, a small group of members--far fewer than required to call an extraordinary assembly--nonetheless did so. This illegitimate extraordinary assembly dissolved the executive board and chose a new executive board, all in violation of the union's statutes and due process. The illegal removal on September 4th of the legitimately elected leadership (Armida Estela Franco. José Roberto Méndez. Kelvin René Rojas. Francisco Andrés Franco, José Abel Cerna, Jenny Elizabeth Barrientos, Eduardo Calles Recibos, Nelly del Carmen Ponce and Jaime Leonel Martinez) represents a usurpation of STISSS by unrepresentative and unduly-elected individuals in violation of its bylaws. The recognition of this illegitimate executive board by the Labor Ministry is an affront to freedom of association, union democracy, and respect for the rule of law.

As a result of a Labor Ministry decision, this minority group has control over the union’s finances and members’ dues, which should have been put under custodianship until the dispute between the two executive boards is resolved. Union activists report their fear that there is a concerted effort to legitimize the new leadership on behalf of the Salvadoran government.

These acts violate fundamental labor norms, the Salvadoran labor code, and El Salvador’s obligations under International Labor Organization conventions. As Labor Minister, it is your role to ensure that the members of the STISSS can exercise their right to elect their leadership without fear.

The AFL-CIO stands in solidarity with STISSS and its legitimate elected leaders. We therefore reiterate the necessity for the Ministry of Labor to fulfill its obligations and remain impartial throughout the entire process of the election of the new executive board on December 13, 2019. We will be following this case closely.

Lastly, we express our hope that President Bukele fulfill his promise to champion working people in El Salvador, a commitment which means guaranteeing freedom of association and upholding the rule of law.

Estimado Ministro Castro:

Escribo para dar un seguimiento a Ia carta del 5 de noviembre que mandé por parte de los doce millones y medlo de mujeres y hombres trabajadores de los Estados Unidos miembros de Ia Federación de Labor y Congreso de Organizaciones lndustriales (AFL-CIO), expresando nuestra grave preocupación por las acciones tomadas por parte del Ministerio de Trabajo y Previsión Social en contra del Sindicato de Trabajadores del Instituto Salvadoreno de Seguro Social (STISSS) para socavar las estructuras sindicales democraticas y Ia autentica voz y representación de los trabajadores. Hoy, en este periodo previo a la asamblea para elegir Ia nueva junta directiva del STISSS el 13 de diciembre de 2019, le exigimos que respete Ia decision de los trabajadores en esa asamblea de elegir su junta directiva y que no interfiere en su proceso interno.

En diciembre de 2018, STISSS eligio a su junta ejecutiva durante su congreso. En abril de 2019, Un pequeno grupo de miembros disidentes (mucho menos del 25% requerido para convocar a una asamblea extraordinaria) convocó una asamblea extraordinaria, disolvió Ia junta directiva y eligió una nueva junta directiva, todo en violación de los estatutos y el debido proceso del sindicato. El Ministerio de Trabajo aceptó el registro de esta nueva junta ejecutiva ilegal y notificó a los Ilderes legitimos el 4 de septiembre de 2019.

La rernoción ilegal del liderazgo legItimamente elegido (Armida Estela Franco, José Roberto Méndez, Kelvin René Rojas, Francisco Andrés Franco, José Abel Cerna, Jenny Elizabeth Barrientos, Eduardo Calles Recibos, Nelly del Carmen Ponce y Jairne Leonel MartInez), Ia usurpación del STISSS por individuos no representativos e indebidamente elegidos en violación de sus estatutos y ci reconocirniento de estajunta ejecutiva ilegitima por el Ministerio de Trabajo es una afrenta a Ia libre asociación, Ia dernocracia sindical y el estado de derecho.

Ademãs, como resultado de una decision del Ministerio de Trabajo, a este grupo minoritario se le ha otorgado Ia cuota sindical de los trabajadores que deberla haber estado bajo custodia hasta que se resolviera Ia disputa entre las dosjuntas directivas. También, sindicalistas expresan su miedo de un esfuerzo concertado para legitimar el nuevo liderazgo como un hecho consumado.

Estos actos violan las normas fundarnentales de derechos laborales, el código laboral salvadoreno, y las obligaciones de El Salvador bajo las convenciones de Ia OIT. Corno Ministro de Trabajo es su deber garantir que los afiliados de STISSS sientan que pueden ejercer su derecho a elegir su liderazgo sin temor.

La AFL-CIO se solidariza con STISSS y sus lIderes legitimos y electos. Por eso reiteramos que Ia necesidad de que el Ministerio de Trabajo se mantenga completamente neutral y objetivo durante todo el proceso electoral para elegir Ia nueva junta directiva del STISSS el 13 de diciembre de 2019. Estaremos pendientes de los avances en este caso.

Al final, esperamos que el Presidente Nayib Bukele cumpla con sti promesa de estar al lado del trabajador salvadoreno y Ia trabajadora salvadorena, Ia cual significa garantizar un ámbito a favor de los derechos sindicales y un estado de derecho.
