Temporary Protected Status: What Workers Need to Know

The Trump administration has terminated Temporary Protected Status for six countries – El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan, and the courts have now allowed these terminations to proceed. If you or a loved one or co-worker are a national of one of these countries with TPS, here is IMPORTANT information that you need to know:

What does the court decision mean for my status?

The timeline for TPS terminations is still uncertain. Legal challenges are ongoing, and the termination dates for each country will vary. For now, the most we can say for certain is that the earliest any worker will lose status is March of 2021.

What does automatic extension of work authorization mean?

The automatic extension means that you can legally work after the printed expiration date on your work permit, or Employment Authorization Document (EAD) until the date listed above. All you have to do is show your boss a copy of the relevant federal register notice for your country. You can find this at uscis.gov/tps.

What should I do if my boss gives me problems?

If your boss challenges your ability to work while you are within the valid extension period for your work permit, contact your union immediately. A sample letter is provided here that outlines the key points you should share with your employer.

What steps do I need to take to prepare for loss of TPS status?

Every person’s case is unique, so it is important to explore your options with an experienced and reputable immigration attorney. Contact your union representative for support and a referral, and to learn more about concrete steps you can take to be empowered and prepared in this uncertain time.

What is Congress doing to address this issue?

Last summer, the House of Representative passed strong legislation that would give a path to citizenship for all TPS workers—now the Senate needs to do the same. Unions are also pushing for a fix for TPS workers in other legislation. The labor movement will be with you in the fight for justice for TPS families until we secure a lasting victory!
